While the LTHHC program is a Medicaid waiver, it might not be the best option, as New York operates many state-level programs for assisted living and in-home care that are not part of the waiver program. One’s home is often their most valuable asset, and if counted towards NY Medicaid’s asset limit, it would likely cause them to be over the limit for eligibility. However, in some situations the home is not counted against the asset limit. If the applicant lives in their home and the home equity interest is less than $955,000 , then the home is exempt from the asset limit. Home equity interest is portion of the home’s equity value that the applicant owns, and the home’s equity value is the current value of the home minus any outstanding mortgage / debt against the home.

If the applicant’s spouse, minor child, or blind or disabled child of any age lives there, the home is exempt regardless of the applicant’s home equity interest, and regardless of where the applicant lives. If none of the above-mentioned people live in the home, the home can be exempt if the applicant/beneficiary files an “intent to return” home and the home equity interest is at or below $955,000. The NY Medicaid MLTC Program delivers all of its benefits through a single Medicaid plan that’s provided by a Managed Care Organization, or MCO. This MCO has a network of health care professionals that can provide services for New York residents in the MLTC Program. The beneficiaries also have some decision-making power of their own when it comes to caregivers through the Consumer Directed Personal Assistance Program .
Medicaid recipients must have their ALP services approved in advance by the Local Social Services District. Benefits provided through the ALP Waiver include skilled nursing care, adult day care, housekeeping, medical supplies, personal emergency response services and other help with activities of daily living . The ALP Waiver does not cover room and board at the “assisted living program,” but ALP Waiver beneficiaries have a higher income limit than other Medicaid beneficiaries for the purpose of paying for that room and board. If an ALP Waiver recipient doesn’t meet that income limit, the state will supplement their income so they can afford the room and board.
